1. Contract
The Contract for a short-term holiday rental shall be made between the Client and Mrs Hazel J Carter. The contract will be entered into when Hazel J Carter issues the conformation form and will be subject to all the following booking conditions.
If for any reason Hazel J Carter is unable to confirm the booking as required she will refund the deposit in full.
2. Payment
Bookings will be confirmed only on receipt of a deposit of one third of the total rental, or if the booking is made within eight weeks of the commencement of the holiday, the full rental.
A deposit of one third of the rental fee, is payable at the time of booking. The balance shall be payable more than seven weeks before the commencement of the rental, if applicable. Non-payment of the balance of the rent on or before the due dates shall be construed as a cancellation of the contract of the Client. For bookings made less than eight weeks before the commencement of the rental the total fee is payable on sending the Booking Form. All payments shall be made payable to Mrs H J Carter and sent to the address at the top of the Booking Form.
A receipt of a deposit does not constitute the confirmation of a booking.
Payments should be made by cheque, or by Sterling Bank Draft direct to our account. Clients who wish to pay by Bank Draft or transfer – Bank Account Number 10042058, Royal Bank of Scotland plc, Sort Code 16-20-18.
Bank charges incurred by overseas payments will be billed to the Client. Any charges raised against Mrs H J Carter by their bank for dishonoured cheques, bank transfers and non-sterling cheque payments will be passed on to the booking party and payment for these charges must be made within five working days.
The required refundable security deposit against breakages will be refunded in full providing nothing is damaged or broken when the Client leaves. The fee will be returned within ten working days of departure.
3. Cancellation
Any cancellation made by the Client for whatever reason shall be in writing and addressed to Mrs H J Carter. On receipt of notice of cancellation, Mrs H J Carter will seek to re-let the property for the period of the booking. However, the following cancellation charges shall apply.
·More than 8 weeks before the commencement of the holiday – loss of deposit.
·Less than 8 weeks before the commencement of he holiday – the full cost of the holiday.
Cancellation Insurance
You are strongly recommended to take out cancellation insurance.
4. Alternative Accommodation
Mrs H J Carter reserves the right to refuse any booking without stating a reason or to cancel, modify or alter arrangements made by the Client.
In the unlikely event that the holiday accommodation ceases to be available for the period of the booking, then all monies paid shall be refunded to the Client in full, and all liabilities of Mrs H J Carter shall then cease.
5. Period of Hire
Rentals commence, unless otherwise specified at 3p.m. on the day of arrival and terminate at 10 a.m. on the day of departure.
6. Number of Persons using the property
The number of persons occupying the property must not exceed the maximum number stipulated in the brochure. Sub-letting, sharing or assignment is not permitted.
7. Complaints
All complaints should be notified to Mrs H J Carter immediately. We will not entertain a complaint once a property has been vacated.
Mrs H J Carter reserves the right to investigate and resolve any problems during tenancy without refund or compensation.
8. Breakage or Damage
The Client is legally bound to reimburse the Owner for replacement or for repairs on demand.
9. Care of the Property
The Client shall take all reasonable and proper care of the property and its contents. They should be left in the same state of repair or condition at the end of the rental period as at the beginning. An additional charge may be made if additional cleaning is required.
10. Pets
Pets are allowed but must be kept under control and in no circumstances neither left alone in the property nor allowed onto furniture or beds. Hirers take full responsibility for pets and agree to pay a surcharge of £15.00 per week per pet.
11. Liability
Mrs H J Carter shall not be under any liability to the Clients or third parties for any loss or damage arising from any breach of contract, negligence, misrepresentation or otherwise.
12. Right of Entry
Mrs H J Carter or representatives of shall be allowed the right of entry to the property at all reasonable time for purposes of inspection.
13. Ownership
In view to the refundable breakage deposit, the Holidaymaker is entitled to request an inventory of contents on arrival and to expect the full return of their monies after the property has been cleaned. Within ten working days following departure.
14. Legal
Mrs H J Carter cannot accept liability for happenings outside her reasonable control such as breakdown of domestic appliances, plumbing, wiring, temporary infestation of pests, damage resulting from exceptional weather conditions, or owner’s negligence resulting in loss, injury or accident.
